Welcome to the Roadstar UK website. These Terms and Conditions apply to the use of this website and to any order for products that you place. Please read them carefully as they affect your rights and liabilities. If you have any questions relating to them please contact our Customer Care Centre before you place an order by e-mailing or calling on 0871 230 1777 (between 9.00am and 6.00pm, Monday to Friday and 12.00pm to 6.00pm Saturday, Sunday and Bank Holidays, closed Christmas Day). Please note that all calls to our Customer Care Centre are charged at 10ppm.

CHANGES
- 1.1. We may change these Terms and Conditions at any time. Any changes will take effect as soon as they are posted, meaning that you will be bound by such changes. To ensure that you are aware of our most up to date Terms and Conditions, you will be asked to read and accept our Terms and Conditions each time you place an order. We also recommend that you print and keep a copy for your records. To print, please press CTRL + P.

USE OF THIS WEBSITE
Registration
- 2.1. You are free to browse this website, without registration. However, you will need to register as a user of this website if you want to place an order.
Your responsibilities
- 2.2. You must ensure that all the information you provide when you register on this website or place an order is true, accurate, current and complete in all respects.
- 2.3. You must notify us immediately of any changes to any of the information you have previously given us by contacting our Customer Care Centre. You can either e-mail or call them on 0871 230 1777 between 9.00am to 6.00pm Monday to Friday and 12.00pm to 6.00pm Saturday, Sunday and Bank Holidays, closed Christmas Day).
- 2.4. If you register on the website, you confirm that you will treat your password details as confidential. If you have any concerns regarding your password or become aware of any misuse then you must inform us immediately by contacting our Customer Care Centre.

PURCHASING PRODUCTS
Eligibility
- 3.1. To be eligible to purchase products on this website you must:
- be over 18 years of age;
- register by providing your real name, phone number, e-mail address, payment details and other requested information;
- stipulate a delivery address on the UK mainland. Please note that PO box numbers, hotels and accommodation addresses are not acceptable;
- possess a valid credit or debit card issued by a bank acceptable to us.
Making a contract online
- 3.2. The following steps have to take place before a contract is made between us:
- after following a set of simple instructions on the website, you place your order for your product on the website by pressing the ‘Place order’ button at the end of the check-out process. Please see our Ordering policy for further details on how to place your order;
- you will see an on-screen acknowledgement of your order. We will also send you an e-mail acknowledging the product that you have ordered and the total cost of your order. Please note that these are an acknowledgement of your offer to purchase the product. They are not an acceptance of your order;
- we accept your order, and therefore the contract is made, when we dispatch the product from our warehouse unless we have notified you that we do not accept your order (see Refusal of order section) or you have cancelled it (see the contract cancellation section).
Refusal of order
- 3.3. We may decline your order for any reason, in which case we will send you an e-mail telling you so. If the reason for declining your order is because we cannot obtain authorisation of your payment details for any reason, then we may invite you to pay by another method.
Prices and Payment
- 3.4. The prices for products that we quote on our website are inclusive of VAT and UK mainland delivery. You will find the total cost of your order in your ‘Basket’, before you submit your order.
- 3.5. We currently accept payment by Visa, Mastercard, Delta, Visa Electron, Switch and Solo. You confirm that the card you use to make payment to us is yours.
- 3.6. We take payment from your card once you have entered your payment details and have clicked the ‘Place order’ button, subject to card authorisation. In the event that we are unable to supply the product, we will let you know as soon as possible. We will give you a full refund if we have already taken payment for the product.
- 3.7. All card payments are processed by Streamline. You pay them a fee of up to 2.5%, which is included in the total price you pay; the balance is paid to Roadstar UK Limited. The total amount you pay, however, is the same, regardless of the payment method.
- 3.8. Although we try very hard to ensure that all information on this website is accurate, occasionally errors may occur. If we discover an error in the price or description of a product that you have ordered, we will let you know and ask whether you wish to continue with your order or cancel it.

DELIVERY
- 4.1. We make no charge for delivery - it is absolutely FREE!
Where we deliver
- 4.2. We only deliver products to customers with mainland UK addresses. We cannot deliver to places outside of the UK mainland such as Northern Ireland, the Channel Islands, Isle of Man, Orkney, Shetland and the Scottish Islands.
How and when we deliver
- 4.3. We have two types of delivery services depending on the nature of product ordered; a parcel delivery service for smaller items and a home delivery service for televisions and larger items. For simplicity, the type of service is automatically determined when an order is placed.
- 4.4. Whether your product is large or small, you will be able to select your preferred date of delivery from a list of available delivery dates during the check out process. The delivery dates available for your order will depend on the delivery address and time you place the order. Delivery will be made on the day that you select for delivery.
- 4.5. All goods must be signed for by an adult aged 18 years or over on delivery.
- 4.6. If no one is at the address when the delivery is attempted we will retain the product and leave notification of delivery. You should call the telephone number on the notification to re-schedule a delivery.
- 4.7. When you re-schedule a delivery, we will re-deliver your product free of charge. However, if our attempts at delivery have been unsuccessful on four occasions, we will inform you by e-mail that we consider our contract cancelled. We will refund you the cost of the product within 14 days of us receiving confirmation that the product has been returned to our warehouse.
- 4.8. We make every effort to deliver products within the estimated timescales; however delays occasionally occur due to unforeseen circumstances. If we have to delay or cancel the delivery for any reason, we will try to contact you as soon as we are able to in order to reschedule your delivery date. Roadstar UK Limited shall be under no liability for any delay or failure to deliver the products within estimated timescales.
- 4.9. Subject to your right to cancel, risk of loss of and damage to products passes to you when the person at the delivery address signs for the delivery.

CONTRACT CANCELLATION
- 5.1. You are entitled to cancel at any time either before or up to 8 working days after delivery.
- 5.2. If you wish to cancel please phone our Customer Care Centre on 0871 230 1777 between 9.00am to 6.00pm Monday to Friday and 12.00pm to 6.00pm Saturday, Sunday and Bank Holidays, closed Christmas Day). or e-mail them. They will give you a return authorisation number.
- 5.3. If your order has already been dispatched, you will be asked to follow the procedure set out in our Returns section. You will be refunded within 14 days of us receiving confirmation that the product has been returned to our warehouse.
- 5.4. If your order has not been dispatched when you cancel, then we will refund you within 14 days of receiving your cancellation.

RETURNS
Non-faulty product(s)
- 6.1. If you have received your product and it is not faulty, you can only cancel if you notify us within 8 working days of delivery. See the contract cancellation section for further details.
- 6.2. You must first obtain a return authorisation number from our Customer Care Team. This must be quoted on all returns. The product must be returned to us complete, unused and in the same condition as it was delivered. Returns should be with the original packaging and accessories. We reserve the right to withhold a percentage of the refund value of returned product if it needs to be re-packaged or if the product is in such condition that it needs to be reduced in price for resale.
- 6.3. In particular circumstances, if at least one of the items that you purchased is large or awkward in size, for example a television, we will arrange to collect them for free. Please telephone our Customer Care Centre on 0871 230 1777 or e-mail them to establish whether free collection applies in your case.
- 6.4. If the item you purchased is small in size, for example a handheld LCD TV, then you will need to arrange for return of the product to us at your own cost, quoting your return authorisation number. In such instances, we recommend that you use a courier that offers shipment tracking service and that you insure the product to its full value while in transit. If you choose not to follow these recommendations we regret that you will be responsible for any loss or damage to the product during transit.
Faulty products
- 6.5. To ensure that we continue to meet the high levels of quality that our customers demand, all of our products undergo a complete quality control check before they are delivered.
- 6.6. In the unlikely event that a fault develops with your product within 12 months of delivery, please contact our Customer Care Centre on 0871 230 1777 or e-mail them to let them know.
- 6.7. You should provide us with proof of purchase when seeking to return a faulty item. If the product is small, for example a handheld LCD TV, we will provide you with details on how to return the faulty product to us and will arrange to replace the product with a new one. If the item is large, for example a television, then we will arrange for a service engineer to visit at your premises to determine the fault. Depending on the fault, we may offer to repair or replace the item. This does not affect your statutory rights.

- 7.1. We may include links to third party sites on our website which we believe may be of interest to you. You acknowledge and agree that if you chose to enter a linked site, we are not responsible for the content on such sites or their availability.
- 7.2. If you use a linked site, any personal information you give them will be dealt with in line with their privacy policy, not ours, so please ensure that you read their privacy policy before you provide any personal information.
- 7.3. You may link to this website, provided:
- you link to our homepage only;
- our website is not loaded into frames on your site; and
- your site or service does not misrepresent its relationship with us or present false information about us.
- 7.4. We reserve the right to withdraw linking permission at any time without prior notice.

- 8.1. The content of this website is protected by copyright, trade marks, database and other intellectual property rights and is made available for your personal non-commercial use only. You may (if necessary to place an order) download such content onto one computer hard drive or print one copy of such content for your non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use any of the content on this website without written permission from Roadstar UK Limited.

LIMITATIONS AND DISCLAIMERS
- 9.1. We promise that we will operate this website with reasonable skill and care and that we will use our reasonable endeavors to correct any faults of which we are aware.
- 9.2. We do not make any promises about the availability of the website. In particular we disclaim any liability in connection with any technical problems you may experience with the website which may result in interruptions to the website, or any bugs or viruses in the website or the server that makes it available.
- 9.3. We do try to ensure that the information on the website is accurate and complete, but sometimes mistakes occur and we therefore do not accept any liability which may arise as a result of any such errors or incomplete information.
- 9.4. Occasionally we are unable to perform our obligations under these Terms and Conditions due to circumstances beyond our reasonable control. In such circumstances including, but not limited to, fire, flood and other acts of God, strikes, trade disputes, lock outs, restrictions of imports or exports, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, our inability or delay in performing our obligations will not be deemed to be in breach of contract.
Rights and remedies
- 9.5. Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, nor will they restrict any of your statutory rights.
- 9.6. Other than as set out in clause 9.5 our maximum liability arising out of any order for the supply of products to you under these Terms and Conditions will be limited to the retail price of the products contained in that order.
- 9.7. To the full extent allowed by law, we will not be liable for any indirect losses that you suffer, whether relating to your purchase of products or to the use of this website, including loss of business profits, loss of anticipated savings, wasted expenditure or any other indirect or special damages.

GENERAL
Severability
- 12.1. If any part of these Terms and Conditions is found to be unenforceable as a matter of law, all other parts of these Terms and Conditions shall not be affected and shall remain in force.
Entire agreement
- 12.2. These Terms and Conditions govern our relationship with you and represent our entire agreement with you.
Assignment
- 12.3. You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
Waiver
- 12.4. If you breach these Terms and Conditions and we choose to ignore your breach, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions again.
Exclusion of third party rights
- 12.5. These Terms and Conditions do not create any right enforceable by any person who is not a party, except that the provisions of these Terms and Conditions may be enforced by Alba plc subject to and in accordance with the Contracts (Rights of Third Parties) Act 1999. Governing law and jurisdiction
- 12.6. The contract between us will be concluded in English. Any disputes or claims arising out of or in connection with the contract are governed by and construed in accordance with the law of England and Wales. If a dispute arises out of or in connection with this contract, we will both attempt to settle it by mediation in accordance with the Centre for Dispute Resolution (CEDR) Model Mediation Procedure. If either or both of us refuse to initiate the mediation procedure within 14 days of the dispute arising or if we both fail to agree terms of settlement within 30 days of the initiation of the procedure, either of us will be free to initiate proceedings in the courts of England which will have exclusive jurisdiction to deal with such dispute.
